Plan Document CreationEmployers who offer benefit plans to their employees are required to maintain written plan documents and to provide them to all eligible employees.
If an employer allows their employees to pay their benefit contributions on a pretax basis, the IRS requires the employer to maintain a written Section 125 Plan. Non-Discrimination TestingIf your company allows employees to pay their benefit contributions on a pretax basis, the IRS requires you to conduct an annual non-discrimination test.
The purpose of the test is to determine whether the benefits provided to highly compensated employees comply with the IRS regulations governing pretax contribution amounts. We do not limit clients to one test per plan year; we'll do at least two - and as many as are needed to bring your plan into compliance at no additional charge. For more information click here. Form 5500 ReportingIf your company has more than 100 employees enrolled in a welfare benefit plan, you are required to file a Form 5500 annually. Plan sponsors must generally file the return on the last day of the seventh month after their plan year ends.
